Terms of Service

These Terms of Service (“Terms”) govern your use of EbookAloud (“Service”), operated by Trilunar Labs LLC (“we,” “us,” or “our”), a Texas limited liability company. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

EbookAloud converts ebook files you upload (EPUB, TXT, and DOC formats) into M4B audiobook files using AI-powered text-to-speech synthesis. The Service is a conversion tool. We do not provide, license, sell, or distribute ebook content.

2. Eligibility

You must be at least 18 years old and capable of entering into a binding agreement to use the Service. By using the Service, you represent that you meet these requirements.

3. Your Content and Ownership Attestation

By submitting a file, you represent and warrant that:

  • You own the content or hold a license or other legal right that permits you to convert it to audio format for your personal use.
  • Your use of the Service does not violate any applicable law, including copyright law.
  • The file is not protected by digital rights management (DRM) technology.

We do not claim ownership of files you upload. You retain all rights to your content. We access your files solely to perform the conversion.

DRM Notice: The Service does not support and cannot process files encrypted with DRM (e.g., files purchased from Amazon Kindle, Apple Books, or protected by Adobe DRM). Uploading a DRM-protected file will result in a failed or degraded conversion. No refund is available for failures caused by DRM-protected content.

4. Payment

The fee for each conversion is displayed at the time of upload. Payment is processed securely by Stripe, Inc. We do not store your payment card information.

Refunds: If your conversion fails due to a technical error on our end, contact us at info@trilunarlabs.com within 7 days and we will issue a full refund. Refunds are not available for failed conversions caused by DRM-protected files, corrupted files, unsupported file variants, or user error.

5. File Delivery and Retention

Upon successful conversion, your audiobook file will be sent to the email address you provide. Download links expire after 48 hours. After 48 hours, your converted file is permanently deleted from our servers. We do not archive, retain, or back up converted files beyond this window. We are not responsible for files that are not downloaded within the delivery window.

6. Output Quality

Conversion quality, chapter detection accuracy, and voice rendering are provided on a best-effort basis. We do not guarantee perfect chapter segmentation, pronunciation, formatting, or fidelity to the source text. The Service is provided to support personal listening use and is not a substitute for professionally produced audiobooks.

7. Prohibited Uses

You may not use the Service to:

  • Convert content you do not have the legal right to convert.
  • Circumvent or attempt to circumvent DRM or other access controls.
  • Distribute, resell, or commercially exploit converted audiobooks without appropriate rights.
  • Upload malicious files, scripts, or content intended to interfere with the Service.
  • Violate any applicable local, state, national, or international law.

8. Intellectual Property

The Service, including its software, design, and underlying technology, is owned by Trilunar Labs LLC and protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of the Service or its technology to you.

9. DMCA Policy

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content converted through the Service infringes your copyright, please send a written notice to our designated DMCA agent:

Your notice must include: identification of the copyrighted work; identification of the infringing material; your contact information; a statement of good faith belief; a statement of accuracy under penalty of perjury; and your signature.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CONVERSIONS WILL MEET YOUR EXPECTATIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRILUNAR LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC CONVERSION AT ISSUE.

12. Indemnification

You agree to indemnify and hold harmless Trilunar Labs LLC and its members, officers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your uploaded content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a revised effective date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
